Request appeal notes mde by clerk
Hi - Can I get hold of the appeal notes made by the clerk. My appeal was unsuccessful even though we had strong mitigation circumstances.
I have contacted the school, who have then contacted the clerk and they have refused the notes.
I thought under the data protection act I could request a copy. Can anyone advise?

You need to contact the clerk, requesting the notes under the Data Protection Act or Freedom of Information Act (Etienne will remember which) , and tell them you will refer them to the Information Commissioner if they refuse.
We did this 2 years ago, eventually got the notes through the ombudsman, but after about 12 months the Information Commissioner came back to us stating the clerk had breached the rules.
Why did they decline your request ? Which school did you appeal to ?

The Q&As now includes a specimen letter. (The request for a copy of the clerk's notes should always be made in writing.)
