If the child is unqualified, then the school should decline.

An unsuccessful appeal should be the end of the matter (unless the conduct of the appeal is subject to an investigation).

They will always decline if the appeal was unsuccessful and as for filling spaces are likely to have a waiting list of qualified children.

So an unqualified child is not at a disadvantage whether they appeal or not if a school has vacancies.

To be considered by a school who has vacancies / waiting list etc then the child must be "qualified" - this is either via the exam score or appeal result.

If they have neither then they cannot be on the waiting list, if there are spaces then the school will start the year with vacancies.
DS's year did that (112 places - 107 kids). Over the next 2 years there were people who moved into the area (and passed the exam) or kids from OOC who had not taken the exam but now decided to have a go.
By year 9 there was a waiting list.
