At appeal a Local Authority will sometimes say that there's an alternative school available (implying that you don't really need to appeal for this one). It is then open to the appellant to say why the "alternative" is not appropriate.
However, I'm surprised they've put this in as part of their written case - it would have been more appropriate for them to raise it as part of the question & answer session at the hearing.
I suggest you wait until after the authority have presented their case, at which point you should be asked if you have any questions. You can then query why they are suggesting a school that has been closed to new admissions since 2009!
If they try to come up with other suggestions, gently point out that you've come to the hearing to explain why this school (the school being appealed for) would best suit your child - not to be negative about any alternatives.

Just a quick message to advise that our daughter has been offered a place from the reserve list - no need to go to the appeal. Thank you to everyone for their help and support and to those of you in the sytem - keep going it will be worth it in the end.
