Hi

I have an appeal in a few weeks for non-qualification and over-subscription.

I think that I have the non-qualification aspect covered as there were extenuating circumstances that came to light after the test - which she failed by 2 marks. We have evidence of this and full support from the primary school. Had she passed she'd have gained a place due to the schools sibling rule

Some information has very recently come to light which I would like to use as part of my reasons for wanting DD2 to go to the same school as DD1.

As the situation is in its early stages and I am not sure what the outcome will be I am not sure what I can say/write to the appeals panel other that I feel that in terms of sibling support I feel that it is important that they are at the same school should the worst case scenario arise.

It is also a very delicate subject and I am concerned as to how to broach it with the appeals panel or how much information I give. I also need to be assured that everything submitted is treated as fully confidential by the school and the admissions panel.

Independent Appeal Panels perform a judicial function regulated by law - the School Admissions Appeals Code 2012. These are the opening paragraphs of the Code:

Section 1: Constitution of Appeal Panels

1.1. Under Section 94 of the School Standards and Framework Act 1998, responsibility for making arrangements for appeals against the refusal of a school place rests with the admission authority of the school. The admission authority and appeal panel must act in accordance with this Code, the School Admissions (Appeal Arrangements) (England) Regulations 2012, the School Admissions Code, other law relating to admissions, and relevant human rights and equalities legislation, for example, the Equality Act 2010.

1.2. Appeal panels perform a judicial function and must be transparent, accessible, independent and impartial, and operate according to principles of natural justice.

Although the Code doesn't expressly cover the issue of confidentiality, it is woven into the fabric of the process, and woe betide anyone who breaks confidence after a hearing. They would be breaking the law, plain and simple.

Regarding the AppealsBox, only 3 of us can view the content - me, Etienne and hermie. If you prefer to PM me alone, I will be happy for you to do that on this occasion.

All panel members will traet it as highly confidential. We do get to hear some upsetting, shocking and disturbing things. All our personal notes, and paper work we have been sent, are handed back to the clerk at the end of the appeals and disposed of as confidential waste.

You do not have to go into the finer details if you do not wish to but as capers has mentioned if it will help with the appeal then mention it
