What to tell an appeals panel?

I just wondered if I could have some advice

My ds got 95% in her level 5 maths SATs

And 3 marks off the level 6 paper

The school told us they did no work towards the level 6 paper as it was the first year they had put children in for it, and they and just sat the top three children, not really knowing what was in it.

She was the only girl in the school that didn't have extra lessons for her SATs as the school said it was unnecessary.

Should I tell an appeals pannel about the level 6 paper or just leave it at the level 5?

Ideally, as much of the above as possible would be in a letter from the school, as the panel may be wary of uncorroborated evidence for obvious reasons.

Failing that, you could just mention the 95% (but it would help to have it confirmed in writing!).

Leave the rest for the Question & Answer session, and hope that something will be asked that gives you a suitable opening. (Information that emerges naturally tends to sound much more convincing!)

It's quite possible someone will say:
Did the school enter many pupils for level 6?
or
95%? - she seems to have done rather well!

Is it harder to win a second appeal when all the spaces saved for appeals have been filled?

It would be unlawful for spaces to be saved for appeals.

Is it disadvantageous to have a late appeal? Possibly - but not necessarily! Appeals are somewhat unpredictable.

How long can it take to set up a new panel date after the EFA have ordered a fresh appeal?

Feel like this has already been the longest year of my life!

It can take around 3 weeks, at least, before an appeal is heard. An earlier date might be possible if an existing slot becomes vacant.

The maximum in-year wait ought to be 30 school days.

on a second appeal following an efa decision, can a new appeal statement be provided by the apellant or does the school have a right to provide the new panel with the old statement from the appellant?

Some appeal administrators have a rule that the admission authority cannot update its case - to ensure that the appellant is not disadvantaged if the school is now above its admission number as a result of successful appeals.

I've yet to come across a re-hearing where the appellant has not been permitted to submit new evidence - but it's something that needs to be checked with whoever is administering the appeal.
