Over subscription
We are in the process of appealing for a place at a grammar school for our child. Pass mark was very high. We live in catchment. So our appeal is over subscription.
My question is..
The school we are applying for isn't full to its net capacity (by nearly 100 children).
Can we argue they could make space for our child without comprising any of the other children that attend there already?

Not really - it sounds as if the extra space is in the wrong place from your point of view, i.e. not in the year group you want a place in.
It depends what the school's case is going to be - if they're complaining about overcrowding in corridors and communal areas, then the point that they're well below net capacity should weaken their case.
However, what usually matters to most appeal panels is the impact that an extra child might have on the year group that you are appealing for.
