Hi everyone
Thank you all so very much for your advice. I have spoekn to my friend who does say she will take this as far as possible to get him his place at his first choice school as clearly there has been a mix up between LEA's. She has said she would sue if she has to, I guess as Etienne suggest she must get everything from each party involved in writing.
I won't tell her this as it is no help but to anyone else on here who will be going through this next year, make sure you copy everything. My husband did and although it may seem mad that you should have to it is clear that it is worth doing so.
I will keep you udpdated as to how she gets on
