FOIs for distribution of scores declined - Nonsuch / WHSG

In response to several FOIs, both Nonsuch and Wallington High have declined to provide distribution scores for this years results. Here is the standard commentary they have provided:

Unfortunately, it is not possible for us to provide a distribution of
scores. Please see the extract below from the School Admissions Code.

Admission authorities must not provide any guarantees to applicants of the
outcome of their application prior to the formal notification of any
offers of a place in a suitable school by the home local authority.

Therefore, we are unable to provide a distribution of scores on this
basis.


Interesting that such information has been provided in every previous year and well before National Offer Day. Also, I can't immediately see how providing that distribution is in any way a "provision of guarantee"... probably a new Data Protection Officer has assumed office?

I believe the national Schools Admissions Code was revised recently. There are very few girls on the high marks, so it is easy to identify your DD as rank number 7 for example and know she has a place if you put the school first. Shame, as I quite like those graphs, but hopefully they'll release one after March.

The admissions code has not changed - a follow-up query to the initial refusal asked a specific question about why the distribution was not provided, and the feedback from GLT was below:
Our Trust has, this year, decided not to provide the information prior to national offer day because it could be perceived as our guaranteeing a place and thus contravening the Admissions Code.
It appears, from their response, that they have simply decided not to provide the information prior to national offer day.

It's a ridiculous response, but parents have little recourse to challenge this.
