Please can you advise whether if on appeal, a place is offered, that place has to be automatically accepted and the previously accepted 2nd offer school place is automatically withdrawn? If it helps, the school we are appealing to go to is in a different LEA than our 'automatic ' offered 2nd place.

Many thanks

Yes, if you are given a place through appeal this should mean that any previously offered place is withdrawn. When different Local Authorities are involved there could be a delay as information is transferred.

This needs checking out.
A couple of years ago a family close to us received a 5th place offer.
They lost their first appeal :( then won a second late appeal and a subsequent offer at that school. :D
It was left to the mum to explain to the 1st school that the place was no longer required and it could be offered elsewhere. No-one at that school was slightly interested.
We found out that the child was 'on the register' at both schools come September! :?

After winning our appeal for a Bucks school from OOC, we told our own LA that the place allocated to our daughter at the local school would not be required. We naturally assumed that the information would be passed on, especially as that school was also oversubscribed and holding appeals. However, the message did not get through and the first the school knew that our daughter would not be joining them was when she did not turn up on the induction day. They had even prepared a welcome pack for her and placed her in a tutor group with one other girl from her class, who then ended up in a class with nobody from her old school. We naturally phoned the school to apologize, but they were very understanding and not at all surprised when we explained that we had notified the LA in the expectation that they would inform the school.  .
