Re: st bernards appeal
I've emailed to the elevenplus email address is that correct ?
Re: st bernards appeal
Not sure which one you mean. It's not the main 11+ exams email address.
The correct address is given if you follow the link at the top of the page (There is a facility here for keeping sensitive information private while seeking advice).

Re: st bernards appeal
I think lovingmum has sent it to the website's office. I will drop them a quick line to say that they should ignore it. (Don't worry lovingmum, they will keep your confidence.)
This is the thread to which Etienne is referring: http://www.elevenplusexams.co.uk/forum/ ... php?t=9907" onclick="window.open(this.href);return false;

Oh dear i did I have resent to the appeals box now .. sorry my head is all over the place
Re: st bernards appeal
No problem. Message now received, and I'll give you my honest opinion.
The letter appears to be in order.
I do understand your concern that they're saying your appeal should have been heard by Langley, but the fact remains that they did hear your appeal, and, as far as I can tell from the information available, the panel gave proper consideration to all the points you put forward.
It would be wrong to think that an appeal panel prioritises cases purely by score, because they don't. You mention two other candidates with lower scores (and no extenuating circumstances) who succeeded. I know you've spoken to the parents, but we can't be sure of all the facts. Even with lower scores, they might possibly have had stronger academic evidence than you - score is only one bit of the academic evidence, not the totality. The panel might even have identified an extenuating circumstance that parents weren't fully aware of. (Parents who win an appeal rarely know what exactly it was that swayed the panel.)
If you wish, you could ask the ombudsman to look into your case, but I'm not sure he will agree to take it on because there's no evidence at the moment that anything was done incorrectly - all we have is a suspicion.
Advice about going to the ombudsman can be found here:

(scroll down to no. 5)
If he did agree to take on the case, I must warn you that it could take months to get to a decision. However, it would have the advantage that an independent investigator would have access to all the papers, could check in detail whether all the correct procedures were followed, and indeed whether the arrangements for consortium appeals are satisfactory.

I just cant help thinking that if I had put them on first on my form it would be an entirely different situation now and thats what makes it unfair

Re: st bernards appeal
Sorry to hear your news Lovingmum, and know just how you are feeling. Being absolutely convinced that there is something wrong with the way appeals are heard at this school, I would urge you to ask for the clerk's notes to see how your decision was reached. In our case the clerk was found to be wanting in this area, and the LGO believed there were errors made, none sufficient to cause a rehearing, though.
I imagine they are being more careful now, but possibly not. I wouldn't want to get your hopes up, but if you're like us, you won't want to give up till you have tried everything possible.
You posted while i was writing this....it shouldn't matter where it comes on the CAF, and the panel should not even know, in my view.

Re: st bernards appeal
I am so dissapointed in the system ... I will be taking it further ... not that I think it will change there mind but because its unfair ... the other two successful candidates both had a much lower mark than us and defo no extenuating circumstances ... even they thought my case academically and points wise was stronger than there's only difference they had listed school first ... in terms of distance from school I'm closest ...
I'm not making a fuss for no reason I know that I just feel they are thinking u didn't put us first so don't deserve a place

Re: st bernards appeal
Would be interesting to know if anyone they gave there 18 places to from appeal had them down as second on there form but still got threw ?
Re: st bernards appeal
I agree that the order of preference shouldn't make a difference.Looking for help wrote:it shouldn't matter where it comes on the CAF, and the panel should not even know, in my view.
The wording in the Code is a bit convoluted to my way of thinking ......
how an appellant has ranked their preferences on the common application form (e.g. if they are appealing for a lower ranked preference school than the one they have been offered) need not be a factor in the panel’s consideration unless this is directly relevant to the grounds for appeal.
