Yes - abbreviated names would probably be understood on one of our regional forums, but this forum deals with appeals all over England, so we can only guess which school 'EGS' might refer to!

Fortunately the appeal process is basically the same everywhere.

I am aware of a quite a few non qualification appeals over the years - but few have posted about them on the forum, it can be a bit quiet on the Skipton front!

The links Etienne has posted show that the important thing is demonstrate evidence of academic ability - as much as possible!

Hi Asterix, I have successfully appealed for two of my three children on non-qualification for EGS and SGHS.

The advice you have already been given is sound. I am assuming that you weren't successful in the review in Jan/Feb time? My experience for EGS differs a little from you there, as we were successful for DS. However, we had to take the appeal for my DD2 to this stage.

OK, here is my advice for what it's worth. If they didn't accept the academic argument first time around, the sad fact is that they are unlikely to accept it now, unless you have new evidence, which we did for DD2. I guess you have more chance the nearer your child was to the cut off point.

Therefore, you must focus on why EGS is the only school that can meet your child's needs. You must clearly demonstrate why he should go there and nowhere else. In my opinion, this is really difficult to prove, - we were unsuccessful with DD1, the rejection letter clearly stated that what we considered to be needs were actually wants, and in hindsight they were probably right.

Good luck, I know the appeals can be quite stressful but I always found the panels to be very considerate.

Bouga and I have discussed this issue before. It is not a requirement in the Code that the school being appealed for must be the only school that can meet a child's needs. The legal test is whether the parent's case - whatever it may be - outweighs the prejudice to the school, and (depending on the context in which the comment was made) I am doubtful about the legal basis for Bouga's rejection letter.

Clearly, though, if you are able to point to 'needs' rather than 'wants', your case will be more compelling.

Hi Etienne, the tenet of the letter was exactly as you stated - that our case did not outweigh the case of the county. The bit about the wants was an addendum to this.
I probably didn't explain this well enough.
