We have our appeal date set and have received a copy of the school's case which states that they have already offered over PAN, that an extra child would cause problems with rooming, moving through the corridors etc etc. We can see from the DfE data that is available about the school that they often far exceed PAN - sometimes by more than 20. Our question is do we need to prove this to the appeals panel? Should we show evidence of this? Or is it enough to say that we can see the numbers fluctuate but results remain consistently high and that we would need to see evidence that it is detrimental to other students when appeal cases are successful (they have already provided us with information about the number of appeals they received in the last two years and how many of those were successful).

Hope this makes sense we feel so worried about the impending appeal!!

No, you don't need to provide the evidence, as they're very unlikely to deny the figures.
However, you could take the precaution of having with you a printout of the DfE data - just in case it's needed.

Thanks Etienne. I didn't want to come across as argumentative, but I can see the flaws in their case and want to make sure the panel can see them too. Will print out the info as you suggest, just in case!
