It is a serious breach of the Code.
    • 2.15 ....... One party must not be left alone with the panel in the absence of the other ........

However, where parents choose not to attend in person, the LA / school rep would still be there to present their case and be questioned on points relevant to that appeal, as they would have been had the parents attended. A quarter of an hour is long enough to consider a straightforward written submission.

RoboR, do you know that there was definitely not an appeal scheduled before yours? Or that someone due to attend later might not have notified the Clerk that they were unable to attend and their case was slotted in early?

Yes, that could explain it.

To quote para. 2.15 in full:
    • 2.15 Admission authorities must ensure that appeal hearings are held in private, and are conducted in the presence of all panel members and parties. One party must not be left alone with the panel in the absence of the other. Where one party is unable to or has failed to attend the clerk must remain with the panel and remaining party at all times.

As we were sitting at the next table and heard and saw it is their any valid reason? (We were 20 mins early) and witnessed everything?

Their were no other appeals, as we were a late appeal but it's water under the bridge. Their case was solid to be fair there was no room for 1 more.

Update:

Emotions are all OVER the place at the moment, have just been offered a place of waiting list so even though our appeal failed (As correctly the school was full to be fair) we are quite over the moon !!!).

Advice to future parents, check the catchment distances and be in catchment, appeal at the correct date and time (do not leave it to a very late appeal as we were away on holiday so missed the main bulk that were being heard).
