Agree Absolutely. The new Code does sayand I would still argue that in this situation the emphasis is important, i.e. the parent shouldn't appear to be appealing for purely negative reasons.

As you say, it is a question of emphasis (and of backing up any assertions you make).
This was in the old code too, and was in the context of the LA attempting to argue that they had made a "suitable" offer. Although I don't believe appellants should themselves set out to focus attention on the alternatives, they would clearly have to respond in this situation. I think the important thing is that they don't become totally negative at this point, but bring the emphasis back to why the school being appealed for would be the best match for their child's needs."Equally, it is open to the parent to state any reasons why an alternative school would be less suitable."

My case is still complicated!
I'm finding this thread very interesting as I am now preparing myself for an new appeal for the place at the local over-subcribed Grammar as opposed to the brand new local academy.
Will I(and anyone else in this situation) need to submit academic evidence as to why the Grammar is more suitable than the offered school?Or the fact the child passed the 11plus exam sufficient(albeit with not quite a high enough score)?

I wouldn't have thought you should need to make a case about overall ability, but you know how murky foundation school appeals are in your part of the world!
I suggest you take all the academic evidence with you just as a precaution, in case the appeal strays on to "qualification territory".
You might actually want some of the academic evidence anyway to support educational arguments you may have for needing a place at the oversubscribed school. For example, if the school specialises in a subject that you child is strong at, evidence of ability in that subject would be very useful.

Capers123, believe me if had the money i'd give it to you! People on this forum seem more genuine than the websites i've visiting, one quote is for around 1200!
Very confused, don't think we've the energy to go on....so upping the local comp for now.
