1.34 Where parents are unsuccessful in applying for a school place for their child,
they must be given reasons and informed in writing of their right to an
independent appeal against the decision.[Admissions Code]

In my experience, LAs are very unlikely to accept an appeal until this has been done.

I am sure you are technically right; and maybe it would not work in many cases. But even if it did not, one would be off to a headstart and could send in a formal refusal letter when it finally arrived.

However, in Kent I used this method earlier this year and had two appeals set up, one for a VA school, and one for a Voluntary Controlled school. But perhaps I was just extremely lucky! But in my experience, none of these schools write to people on the waiting list to tell them that they have not got a place. It is just understood that if you are on the waiting list your haven't got a place.
