mitigating circumstances at appeal

We are appealing on behalf of our son who has already been assessed by the IAB. Can mitigating circumstances still be taken into account at the appeal?

In my limited experience, I would say yes. You have to show that the IAB wasn't fair as they didn't have all the information.

This is an uphill struggle as you were supposed to let the school know in December if there were any matters that would affect your son, but you say that only known now.

In addition, I would say that unless they have changed the IAB a lot since last year, the whole process could be flawed. The ombudsman asked a lot of appeals to be re-run last year as first time round appeals were denied on the grounds of an IAB had taken place, but for various reasons the IAB wasn't fair.
