expelled-what next?
hi hoping for some good nuggets of advice here.
my friend's dd has been expelled from her indie. she is in year 9 and the school felt it just couldn't cope anymore. she is now on a waiting list but all the local comps are full. hopefully a space for yr10 will come up, my friend is worried as its gcse time
i should add dd has adhd but on no meds, behavioural problems and learning difficulties but no statement. my friend has special guardianship, does this make a difference, are children in care more likely to be given a school place? home schooling is not ideal lets hope it doesnt come to that.

1.7 All schools must have oversubscription criteria for each ‘relevant age group’ and the highest priority must be given, unless otherwise provided in this Code, to looked after children 17 and previously looked after children. Previously looked after children are children who were looked after, but ceased to be so because they were adopted 18 (or became subject to a residence order 19 or special guardianship order 20). Further references to previously looked after children in this Code means such children who were adopted (or subject to residence orders or special guardianship orders) immediately following having been looked after.

She will be first on the waiting list (or should be!) for every school the parent has applied for - unless there is another looked after child on the list with higher priority under the oversubscription criteria (e.g. distance).20 See Section 14A of the Children Act 1989 which defines a ‘special guardianship order’ as an order appointing one or more individuals to be a child’s special guardian (or special guardians).
A few schools do place arbitrary limitations on admission to Year 10 because GCSE courses have started in the 3rd term of Y9, but an appeal panel would take a very dim view of the refusal to offer a place, if one was vacant, to a looked after child on those grounds.
Even if there are no vacant places, the parent can still appeal against oversubscription.

Do they want to appeal? A school can't just exclude a child because 'they cannot cope' with them ...

Agree with Sally Ann although they shouldn't indies can pretty much do as they please. At work we plenty who have been told to leave over issues most schools could cope with but they just don't want to lupset current and future customers.

Its such a relief to hear that she will be given first priority. The school really did all they could but one of the final straws was when another girl was hospitalized because of dd's violence.
Hope she settles down quickly, leaves with qualifications and doesn't become a tragic statistic. Her "mum" (my friend) is amazing.

This sounds like a very difficult situation all round. Does she have any input from CAHMS or is she and her guardian getting support to help manage her behaviour?MamaBear wrote:Its such a relief to hear that she will be given first priority. Her G.P is really helpful and he refers her to get help from the hospital consultant and CAMHS.

She might be better place in a state school over an Indie. Some Indie because of make up of their student might not have the specialised support to deal with children with SEN. This could include an SENCO who is experienced in providing different strategies to support children who have ADHD, support staff to provide additional 1:1 support in the classroom.
Also some children might be entitled to a Education Health care plan depending on their needs which most Indie schools will not entertain due to the cost incurred.
